Breaking: AAC Drags Tinubu, NASS to Court Over Europe Trip
The African Action Congress (AAC) has sued President Bola Tinubu at the Federal High Court, Abuja, for allegedly embarking on a month-long vacation in Europe without formally notifying the National Assembly.
The suit, marked FHC/ABJ/CS/2358/2026, also lists the Attorney-General of the Federation, Senate President, Speaker of the House of Representatives and the National Assembly as defendants.
Filed by lawyer Inibehe Effiong on behalf of AAC, the party is asking the court to declare that Tinubu violated Section 145(1) of the 1999 Constitution by leaving Nigeria on August 30, 2026, without transmitting a written declaration to the leadership of the National Assembly.
According to the AAC, the President is mandatorily required to notify the Senate President and the Speaker before proceeding on vacation, for any number of days.
The party further wants the court to declare that the failure to do so is “undemocratic and a gross violation of the Constitution.”
The AAC also accused the National Assembly of failing to invoke Section 145(2) to empower the Vice-President to act as President after Tinubu had been away for over 21 days.
It is seeking an order of perpetual injunction to restrain the President from going on any future vacation without complying with the constitutional requirement.
The court has directed the defendants to enter appearance within 30 days of service.
No hearing date has been fixed.
